Terms of Service

These Terms of Service ("Terms") govern your access to and use of www.engagedheadhunters.comand the services provided by Engaged Headhunters ("we," "us"), a boutique executive search firm based in Virginia, USA. By using the Site, you agree to these Terms.

1. Use of the Site

You agree to use the Site lawfully and not to attempt to access, scrape, or disrupt the Site or its underlying systems. Site content is provided for informational purposes; nothing on the Site is legal, tax, financial, or employment advice.

2. Candidate & client engagements

Search engagements are governed by separate written agreements (engagement letters, MSAs, or platform agreements). Nothing on the Site constitutes an offer or contract for executive search services. Engagement scope, fees, and replacement-guarantee terms are agreed in writing per engagement.

3. Webinars & training events

Free live training events are provided as-is for educational purposes. Earned bonuses are conditional on live attendance through completion. Replays are not provided unless explicitly stated in the registration confirmation. We reserve the right to reschedule with reasonable notice.

4. Intellectual property

All Site content (text, graphics, logos, software) is owned by Engaged Headhunters or licensed to it and protected by U.S. and international copyright, trademark, and other laws. You may not copy, reproduce, or create derivative works without written permission.

5. Third-party services

The Site links to and integrates with third-party services (e.g., GoToWebinar, Google Analytics, calendaring tools). We are not responsible for those services' content, terms, or practices.

6. Disclaimers

THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGAGED HEADHUNTERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

8. Indemnification

You agree to indemnify and hold Engaged Headhunters harmless from any claims arising from your use of the Site or violation of these Terms.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Exclusive jurisdiction lies in the state and federal courts located in Virginia.

10. SMS / Text messaging program

By submitting a form on the Site that includes a phone number and checking the associated SMS consent box, you expressly opt in to receive recurring text messages from Engaged Headhunters. The SMS program covers hiring updates, candidate scheduling, training reminders, and search status communications. Message frequency is up to four messages per month. Message and data rates may apply, set by your wireless carrier.

You may opt out at any time by replying STOP to any message. For help, reply HELP or contact privacy@engagedheadhunters.com. Consent to receive text messages is not required as a condition of any service we provide. The SMS program is operated under our A2P 10DLC brand registration with The Campaign Registry. Carrier and device compatibility may vary.

We do not sell, rent, or share mobile phone numbers or SMS opt-in data with third parties for marketing purposes. See our Privacy Policy for full details on how SMS data is handled.

11. Changes

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
